Terms of Service

These Terms of Service ("Terms") govern your access to and use of the toT website, the toT desktop application, and related product pages and materials made available by Cibersino ("Cibersino," "Operator," "we," "us," or "our").

By accessing or using the website or the app, you agree to these Terms. If you do not agree, do not use the website or the app.

1. About toT

toT is a desktop application designed to turn text into estimated reading time and to support reading planning and related workflows. Depending on the feature you choose to use, toT may support text import and extraction from files, local editing, word and character counting, configurable WPM presets, saved text snapshots, a task editor, a stopwatch, and a reading speed test.

Some features may connect to third-party services only when you explicitly choose to use those features.

2. Open-Source Licensing

The toT software and source code are distributed under the MIT License.

These Terms are intended to govern your use of the website, product materials, and the app as made available by Cibersino, but they do not limit any rights expressly granted to you under the MIT License or under any applicable third-party open-source license distributed with the app.

If there is any conflict between these Terms and an applicable open-source license governing a specific software component, the open-source license controls with respect to that component.

3. Permitted Use

You may use the website and the app only in compliance with applicable law and these Terms.

You must not:

• use the website or the app for unlawful purposes;
• interfere with, disable, disrupt, or circumvent security features or technical restrictions;
• misrepresent your identity or your relationship to the app;
• use the website or the app in a way that infringes the rights of others.

4. Your Content and Responsibility

You remain responsible for the text, files, links, and other content that you input, import, edit, save, or process with toT.

You are responsible for ensuring that you have all necessary rights or permissions to use that material. You are also responsible for reviewing any output before relying on it and for maintaining your own backups where appropriate.

5. Privacy and Data Handling

Your use of toT is also governed by the applicable privacy materials published on the official toT website, including the App Privacy Policy and, where relevant, the Google OCR Privacy section.

toT is designed to be local-first for ordinary use. As described in the current product materials, settings, current text, saved snapshots, task data, and reading speed test state are stored locally on the user's device. Google OCR is optional and user-triggered. Update checking is limited to public release information.

6. Third-Party Services and Optional Google OCR

Some features depend on third-party services or third-party websites.

6.1 Google OCR

If you choose to activate or use Google OCR, the app may connect to Google through your system browser and may send only the files you explicitly select for that OCR operation.

Use of Google OCR is also subject to Google's own terms, policies, availability, technical limitations, and authorization requirements.

6.2 GitHub and External Links

The app may check public release information on GitHub and may open external links in your system browser when you explicitly request it.

Third-party websites and services are not controlled by Cibersino, and Cibersino is not responsible for their content, privacy practices, availability, or terms.

7. No Warranties

The website and the app are provided "as is" and "as available," to the maximum extent permitted by applicable law.

toT is a practical reading and planning tool, not a guarantee of accuracy or uninterrupted operation. Cibersino does not warrant that estimated reading times, OCR results, extracted text, imported content, calculations, or other outputs will be complete, accurate, error-free, uninterrupted, or fit for a particular purpose.

8. Limitation of Liability

To the maximum extent permitted by applicable law, Cibersino shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of data, loss of profits, loss of business, or business interruption arising out of or related to your use of, or inability to use, the website, the app, or any third-party service used with them.

Nothing in these Terms excludes or limits liability to the extent such exclusion or limitation is prohibited by applicable law.

9. Changes, Updates, Suspension, or Discontinuation

Cibersino may modify, update, suspend, or discontinue the website, the app, or any feature at any time, including for technical, legal, security, or maintenance reasons.

Cibersino is not obligated to provide ongoing support, maintenance, or future updates. Unless expressly stated otherwise, the app does not automatically download or install updates; update and download flows remain user-directed through official release pages or other public materials.

10. Intellectual Property and Notices

Except where software or materials are distributed under an applicable open-source license, the website design, branding, logos, product text, and other non-code materials made available by Cibersino remain the property of their respective owners.

Third-party names, logos, and services remain the property of their respective owners.

11. Changes to These Terms

We may revise these Terms from time to time by publishing an updated version on the official toT website.

The updated Terms will take effect on the stated effective date. Your continued use of the website or the app after that date means that you accept the revised Terms.

12. Governing Law and Jurisdiction

These Terms are governed by the laws of Chile, excluding its conflict-of-laws rules.

Any dispute arising out of or relating to these Terms, the website, or the app shall be submitted to the competent courts of Chile, unless applicable law requires otherwise.
